DOTHAN, Ala. — A Dothan woman has filed a lawsuit against a local discount store, claiming she was injured by a used medical sharps container that was sold to her, allegedly due to the store’s negligence.
Terry Ann Dunning, in a complaint filed Friday in Houston County Circuit Court, alleges that on July 6, 2024, she purchased a medical sharps container from Wiregrass Bargains, located on West Main Street in Dothan. Dunning asserts that the store had repackaged the container, which had been previously used by another customer. The container, according to the lawsuit, contained several medical needles, one of which was protruding from the side.
Dunning claims that when she opened the box, she was cut by the needle, suffering “serious and permanent bodily injury” in the process. The lawsuit also mentions the financial hardship she has faced as a result of the injury.
In the court filing, Dunning accuses Wiregrass Bargains of negligence in selling the used sharps container, which should have been safely disposed of or returned to the manufacturer instead of being resold.
As of Saturday afternoon, the complaint had been forwarded to the Houston County Sheriff’s Office for service to Wiregrass Bargains. However, the process had not yet been completed. Once served, the store will have 30 days to respond to the allegations.
No attorney for Wiregrass Bargains has been listed in the court records at this time. The case continues to develop, and it remains to be seen how the store will address the claims made by Dunning in the complaint.
